Terms of Service

These Terms of Service ("Terms") govern your access to and use of LessonDeck (the "Service"), operated by Phareon LLC ("Phareon," "we," "us," or "our"), available at www.lessondeck.org. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age to use LessonDeck. The Service is designed for K-12 teachers, educators, instructional coaches, and curriculum designers. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

Student accounts are not supported. If you are under 18, you may not create an account or use the Service.

2. Account Registration

To use the Service, you must create an account with a valid email address and password. You are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • All activity that occurs under your account.
  • Notifying us immediately at support@lessondeck.org if you suspect unauthorized access to your account.

Shared accounts are strictly prohibited. Each subscription is licensed to a single individual. Any account suspected of being shared between multiple users will be banned immediately and all payments forfeited, as allowed by applicable law. This determination is at the sole discretion of Phareon LLC staff. If your account is banned, you may contact us through our support page to appeal the decision.

We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised or are being used in violation of these Terms.

3. Service Description

LessonDeck is an AI-powered lesson planning platform that generates standards-aligned lesson plans for K-12 educators. The Service includes:

  • AI-generated lesson plans based on your grade level, subject, state standards, and topic inputs.
  • A personal lesson library for saving, organizing, and managing generated plans.
  • Export functionality (PDF, DOCX, PPTX formats).
  • Subscription management and billing.

Lesson plans are generated using artificial intelligence and should be reviewed, adapted, and validated by a qualified educator before classroom use. LessonDeck is a planning aid, not a substitute for professional pedagogical judgment.

4. Subscriptions & Billing

Current subscription plans and pricing are available at www.lessondeck.org/pricing. Plans and pricing are subject to change. We will notify you of material price changes at least 30 days before they take effect.

4.1 Auto-Renewal

Paid subscriptions automatically renew at the end of each billing period using the payment method on file. You may cancel your subscription at any time before the renewal date through your account settings or our payment processor's customer portal. Cancellation takes effect at the end of the current billing period — you retain access to paid features until that date.

4.2 Refunds

You may request a full refund within 3 days of any paid purchase, no questions asked, provided you have not exported any content from your account during that period. Refund requests can be submitted at support@lessondeck.org. Refunds are processed to the original payment method within 5-10 business days.

4.3 Usage Resets

Usage limits (such as lesson generation credits) reset on your plan renewal date, not the first of each calendar month. Your renewal date is the anniversary of your subscription start date. Unused credits do not roll over. Burst Pack credits do not expire and are consumed after your plan allocation is exhausted.

5. AI-Generated Content

5.1 Ownership

Lesson plans generated by LessonDeck are created by artificial intelligence based on your inputs. You receive a non-exclusive, non-transferable, revocable license to use generated lesson plans for your personal educational purposes, including classroom instruction, lesson planning, and curriculum development.

5.2 Restrictions

You may not:

  • Redistribute, resell, or commercially publish generated lesson plans.
  • Upload generated content to third-party marketplaces (including but not limited to Teachers Pay Teachers, Etsy, or similar platforms).
  • Represent AI-generated content as entirely your own original work for publication or professional credit.
  • Use the Service to generate content for purposes other than K-12 education.

5.3 Disclaimer

While we do our best to provide a reliable service and curate the best output, AI can make errors. AI-generated lesson plans, assessments, and other content are provided "as-is" and may contain inaccuracies, omissions, outdated information, or content that does not align with your specific curricular requirements. It is your responsibility to review, edit, and validate all AI-generated content before use in a classroom setting. LessonDeck does not guarantee the accuracy, completeness, or suitability of any AI-generated content for any particular purpose.

6. Your Content

Content you create or upload to LessonDeck (including topics, objectives, custom instructions, and modifications to generated plans) remains your property. By using the Service, you grant Phareon a limited, non-exclusive license to process your content solely for the purpose of providing the Service (e.g., sending prompts to our AI provider, storing plans in your library).

Your content is yours. We do not share your content with other users. We do not use your content to train AI models. When you use AI features, your inputs are transmitted to our AI provider for processing. We encourage you to review our AI provider's data practices and to avoid including sensitive or personally identifiable information in AI prompts.

7. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Attempt to access other users' accounts or data.
  • Reverse engineer, decompile, or disassemble the Service or its underlying technology.
  • Use automated scripts, bots, or scrapers to access the Service or generate content.
  • Circumvent usage limits, rate limits, or security measures.
  • Upload malicious code, viruses, or harmful content.
  • Use the Service to generate content that is hateful, discriminatory, sexually explicit, or promotes violence.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Include student personally identifiable information (PII) in lesson plan prompts.
  • Attempt to manipulate, bypass, or circumvent AI content generation through prompt injection, prompt engineering exploits, jailbreak techniques, system prompt extraction, instruction override attempts, or any other methodology designed to alter the intended behavior of the AI system, extract underlying system instructions, generate content outside the platform's intended educational purpose, or cause the AI to produce outputs that violate these Terms of Service.
  • Use the Service to probe, test, or benchmark the AI system's capabilities, limitations, or safety guardrails for purposes unrelated to legitimate educational content creation.
  • Systematically generate content for the purpose of resale, redistribution, or populating competing services.

Violation of these rules may result in immediate account suspension or termination without refund, at the sole discretion of Phareon LLC.

8. Intellectual Property

The Service, including its design, code, features, branding, logos, and documentation, is owned by Phareon LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our prior written consent.

"LessonDeck" and the LessonDeck logo are trademarks of Phareon LLC. You may not use our trademarks without our prior written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or secure.
  • AI-generated content will be accurate, complete, current, or suitable for any specific classroom context.
  • The Service will meet all of your requirements.
  • Any defects in the Service will be corrected.

You use the Service at your own risk. You are solely responsible for reviewing and validating all AI-generated content before use in any educational setting.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PHAREON LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO LESSONDECK IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

USE OF THE SERVICE IS AT YOUR SOLE RISK AND DISCRETION. BY USING THE SERVICE, YOU IRREVOCABLY AGREE TO HOLD PHAREON LLC HARMLESS FOR ANY AND ALL CLAIMS ARISING FROM YOUR USE OF THE SERVICE, FOR ANY REASON.

11. Indemnification

You agree to indemnify, defend, and hold harmless Phareon LLC, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your violation of any applicable law or regulation.
  • Content you submit to or through the Service.
  • Your use of AI-generated content in any educational or other setting.

By using the Service, you acknowledge and agree that your use is voluntary and at your sole risk. This indemnification obligation survives the termination of your account and these Terms.

12. Dispute Resolution & Arbitration

12.1 Mandatory Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Delaware, or at a location mutually agreed upon by the parties. For any arbitration filed for damages totaling less than $25,000, either party may appear by video conference rather than in person.

12.2 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against Phareon LLC.

12.3 Opt-Out

You may opt out of the mandatory arbitration and class action waiver provisions by sending written notice to support@lessondeck.org within 30 days of creating your account. Your notice must include your name, email address associated with your account, and a clear statement that you wish to opt out of arbitration. If you opt out, disputes will be resolved in the state or federal courts located in Delaware.

12.4 Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought in the state or federal courts located in Delaware.

14. Termination

You may cancel your subscription at any time through your account settings. When you cancel, you retain access to paid features through the end of your current billing period. Your account will not be billed on your next renewal date. You will not have access to any new releases or features added after your subscription ends.

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties.

Upon termination, the following provisions survive: Sections 5 (AI-Generated Content), 8 (Intellectual Property), 9 (Disclaimer of Warranties), 10 (Limitation of Liability), 11 (Indemnification), 12 (Dispute Resolution), and 13 (Governing Law).

15. Changes to These Terms

We may update these Terms at any time. When we do, we will update the "Last Updated" date at the top of this page and post the revised Terms here. Your continued use of the Service after the updated Terms are posted constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service.

General Provisions

  • Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Phareon LLC regarding the Service.
  • Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
  • Waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
  • Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.
  • Force Majeure. We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, acts of government, pandemics, or internet outages.
